PUBLIC OFFER
for provision of cargo and parcel delivery services
This document constitutes an official public offer of Silk Way Plus LLP, operating under the brand name Shipto (hereinafter referred to as the “Company”), to conclude a contract for international delivery services of parcels and commercial cargo with any individual or legal entity (hereinafter referred to as the “Client”) under the terms and conditions set forth below.
By placing an order on the website www.shiptollc.com, the Client confirms full ознакомление with and unconditional acceptance of this Public Offer.

1. Subject of the Agreement
1.1 The Company provides services for organizing international delivery of courier parcels and commercial cargo in the following directions:

• USA – Kazakhstan
• USA – Turkmenistan.

1.2 The Company undertakes to organize transportation, storage and delivery of the cargo (parcel), and the Client undertakes to pay for the Company’s services in accordance with the terms of this Public Offer.
1.3 The Company is not the manufacturer or seller of goods and bears no responsibility for their quality, properties or compliance with the Client’s expectations.
1.4 Delivery of the cargo (parcel) is carried out by the Company to Astana International Airport (Republic of Kazakhstan) or to another destination airport additionally agreed by the Parties.
1.5 The Company’s delivery obligations shall be deemed fulfilled from the moment the cargo is handed over to the Recipient at Astana International Airport or at the Company’s warehouse after completion of customs procedures, unless otherwise agreed by the Parties.

2. Cost of Services
2.1 The cost of delivery of each parcel or cargo is calculated individually based on:

• actual (gross) weight,
• volume,
• declared value of the cargo,
• region and method of delivery.

2.2 Volumetric weight is calculated using the formula: L × W × H (cm) / 5000,
and the greater of the actual weight or volumetric weight shall be applied.
2.3 Current tariffs are published on the
website www.shiptollc.com and constitute an integral part of this Public Offer.
2.4 The tariffs published on the website include delivery of cargo (parcel) to Astana International Airport and do not include door-to-door delivery, unless otherwise agreed by the Parties separately.

3. Payment Procedure
3.1 Payment for services is made by the Client in Kazakhstani tenge (KZT) at the foreign currency selling rate of Halyk Bank of Kazakhstan on the date of payment.
3.2 Payment must be made before the cargo or parcel departs from the USA.
3.3 Payment is deemed completed upon receipt of funds to the Company’s bank account.

4. Refund Policy
4.1 After payment for delivery services and submission of the cargo to the departure airport in the USA, refund of funds is not possible.
4.2 Refund of payment for delivery services is possible only before the cargo is delivered to the departure airport in the USA.
4.3 If the Company has incurred actual expenses (logistics, warehouse services, documentation processing and other costs), such expenses shall be deducted from the refundable amount.

5. Rights and Obligations of the Client
5.1 The Client is obliged to:

• provide accurate information about the contents of the parcel;
• not submit prohibited goods for delivery;
• ensure proper packaging of the parcel according to the nature of the contents and delivery conditions;
• correctly and clearly complete and sign the shipment declaration (questionnaire).

5.2 The Client undertakes not to submit parcels without providing information about properties that may cause harm to the Company’s property or personnel, third parties, the environment or vehicles.
5.3 Parcels are accepted by the Company in packaged form. Acceptance and delivery are carried out by number of packages without inspection of internal contents.
5.4 When providing a packing list or when there is suspicion of prohibited items or substances, the Client must submit the parcel to the Company in unsealed packaging.
5.5 The Client acknowledges that the Company:

• does not check completeness or functionality of the contents;
• does not provide consultations regarding consumer properties of the goods to either the Client or the Recipient.

6. Rights and Obligations of the Company
6.1 The Company undertakes to ensure the safety of the cargo (parcel) from the moment of acceptance until delivery to the Recipient.
6.2 The Company has the right to:

• refuse acceptance of prohibited cargo;
• suspend delivery if violations by the Client are identified;
• request additional documents for customs purposes.

6.3 For customs clearance and receipt of the parcel at Astana International Airport, a notarized power of attorney from the Sender in the name of the Company’s employee is required.

7. Liability of the Parties
7.1 The Company is not liable for loss, shortage or damage of a parcel caused by improper packaging by the Sender.
7.2 The Company is not liable for non-delivery of goods to the Company’s warehouse in the USA by the Sender or third-party courier services.
7.3. The Company shall be liable for loss or damage of the cargo (parcel) unless it proves that such loss or damage occurred without its fault.
7.4. The Client bears responsibility for the accuracy of the information provided about the cargo.

8. Dispute Resolution
8.1 All disputes and disagreements arising between the Parties shall be resolved through negotiations.
8.2 If settlement through negotiations is not possible, disputes shall be resolved in court at the location of the Company.

9. Final Provisions
9.1 This Public Offer enters into force from the moment of its publication on the Company’s website.
9.2 The Company has the right to amend this Public Offer unilaterally without prior notice to the Client.
9.3 The current version of the Public Offer is always available on the website www.shiptollc.com.
